1. Ownership

All content on pivotalmotioneducation.physio is protected by copyright. Unless we say otherwise on a particular page, that copyright is owned by Pivotal Momentum Pty Ltd (ABN 84 640 834 235), in conjunction with Pivotal Motion Physiotherapy. Some material is owned instead by the author of the article, and some is used by us under licence from someone else.

Protected content includes our educational articles, headings and article structure, images, diagrams, illustrations, photographs, video, downloadable material, page layout, design, styling and code, and the selection and arrangement of the library as a whole.

Copyright in Australia arises automatically under the Copyright Act 1968 (Cth) when a work is created. No registration is required, and the absence of a copyright symbol on a page does not mean the page is free to use.

Authors also hold moral rights under Part IX of the Copyright Act 1968 (Cth). Those are the right to be identified as the author of a work, the right not to have authorship falsely attributed, and the right to have the integrity of the work respected. Please do not publish our material without its author credit, and please do not alter it in a way that misrepresents the clinical content.

2. What you may do with our content

We publish this material so that practitioners, students and interested readers can learn from it. Subject to the rest of this policy, we grant you a personal, non exclusive, non transferable, revocable licence to:

  • read, view and search the content on this site;
  • print or save a copy of an individual article for your own study, professional development or clinical reasoning;
  • quote a short extract, with clear attribution to Pivotal Motion Education and a link to the original article; and
  • link to any page on this site, from anywhere, without asking us first. Links are welcome.

You may also rely on the fair dealing provisions of the Copyright Act 1968 (Cth), which permit certain uses for research or study, criticism or review, and reporting news. Fair dealing is narrower than people assume. It does not cover copying an article into your own commercial or clinical materials.

3. What you may not do

You may not, without our prior written permission:

  • reproduce, republish or post our content, in whole or in substantial part, on any other website, blog, social media account, intranet, learning platform or app;
  • reproduce our content in patient handouts, exercise sheets, rehabilitation programs, clinic resources, information packs or any other material distributed by another practice, whether or not you charge for it, and whether or not you credit us;
  • include our content in course materials, lecture slides, workshop notes, training manuals, assessments, textbooks or professional development sessions, including material you supply free of charge;
  • sell, license, rent or otherwise commercialise our content;
  • adapt, translate, rewrite or create derivative material from our content, including summaries produced for redistribution;
  • remove or alter any copyright notice, author name, byline, disclaimer or attribution;
  • scrape, harvest, crawl or bulk download the site by automated means, other than an ordinary search engine crawler operating consistently with our robots file;
  • use our content to train, fine tune, ground or otherwise develop any artificial intelligence or machine learning system. We expressly reserve our rights in relation to text and data mining; or
  • use our content in a way that suggests we endorse you, your practice, your product or your teaching, or that we have reviewed material we have not reviewed.

The two clauses in bold matter most to us, because they are the uses we see most often. Educational writing is the product of this business, not marketing material for other practices. If our articles are useful to your clinic or your teaching, please ask. We are usually happy to say yes.

4. Asking for permission

Legitimate reuse is welcome and we would rather grant it than argue about it. Send a request to support@pivotalmotioneducation.physio and include:

  • your name, your practice or organisation, and your role;
  • exactly which article or material you want to use, with the address of the page;
  • how much of it you want to use;
  • how it will be used, who will see it, and whether it is free or paid;
  • the format and the intended publication or distribution date; and
  • how you propose to credit us.

We will acknowledge your request within 5 business days and give you an answer within 20 business days. Permission, if granted, is specific to the use described. It does not carry over to another use, another year or another organisation. Any permission we give is on the conditions we set at the time, which will usually include attribution in this form:

We may refuse a request, and we do not have to give reasons.

5. Trade marks and brand

“Pivotal Motion Education”, “Pivotal Motion”, our logos, our colours and our page styling are our trade marks and brand assets, whether or not they are registered.

You may not use them as your own, in your business name, domain name, social media handle, product name or advertising, or in any way that suggests an association with us or an endorsement by us. You may use our name factually, for example when citing an article as a source. Trade marks belonging to other organisations that appear on this site remain the property of their owners.

6. Third party and licensed content

Some material on this site belongs to other people. That includes stock photographs and illustrations we hold under licence, images supplied by manufacturers or suppliers, quoted extracts, and material reproduced with permission. Those items are used under licences that do not allow us to pass rights on to you. Nothing in this policy grants you any right to use third party material. If you want to use it, contact the owner.

7. Material you send us

If you send us a comment, a question, an article, an image or any other material, you keep ownership of it. You give us permission to publish, store, reproduce and adapt it in connection with this site. In plain terms, that permission is not exclusive, we do not pay for it, it applies wherever the site is read, and it continues after you send the material. You confirm that you are entitled to give that permission and that the material does not infringe anyone else’s rights. You must not send us anything that identifies a patient.

8. Infringement and takedown

If you believe we have infringed your rights. Send a notice to support@pivotalmotioneducation.physio. Tell us your contact details, describe the work you own, give the address of the page on our site where it appears, and set out the basis of your claim. Confirm that you are the owner, or that you are authorised to act for the owner. If material on our site infringes someone else’s rights, we will remove or correct it. We would rather fix a genuine mistake quickly than defend one.

If we believe you have infringed ours. We will usually start by writing to you and asking for the material to be removed. Most of the time that is the end of it. If it is not, we reserve all rights and remedies available to us under the Copyright Act 1968 (Cth), the Trade Marks Act 1995 (Cth) and the general law, whether or not we have exercised them before.
