1. Who we are

This website, pivotalmotioneducation.physio (the “Site”), and the Pivotal Motion Education brand are published by Pivotal Momentum Pty Ltd (ABN 84 640 834 235), in conjunction with Pivotal Motion Physiotherapy. In these terms (the “Terms”), “we”, “us” and “our” mean that publisher, and “you” means any person who accesses the site.

Pivotal Motion Education is a separate legal entity from the physiotherapy practice Pivotal Motion Physiotherapy Pty Ltd (ABN 21 155 577 834). Reading this site does not create any relationship with that practice, and nothing on this site is provided by that practice as clinical care.

2. Your agreement to these terms

By accessing or using this site you agree to these terms. If you do not agree, please do not use the site. These terms apply every time you visit, whether or not you read them on that visit.

3. Changes to these terms

We may update these terms from time to time, for example when the law changes or when we add new features. The current version is always the one published on this page, and the effective date at the top tells you when it last changed.

If we make a change that materially affects your rights, we will publish a notice on this page before the change takes effect. The version in force when you use the site, or when you buy anything from us, is the version that governs that use or purchase.

4. Who may use this site

This site is written for physiotherapists, exercise physiologists, allied health professionals, health students, strength and conditioning coaches, fitness professionals, researchers and other interested readers, including readers outside Australia.

The site is not designed for children. If you are a young person, please use it with the involvement of a parent, guardian or supervising educator.

5. Permitted use of the site

You may read, search, print and share links to the material on this site for your own information, study and professional practice. That is what it is here for.

Your use of our written and visual content is governed by our Copyright and Intellectual Property Policy, which forms part of these terms. In short, you may use our articles to inform your own practice and learning. You may not reproduce them in your own patient handouts, clinical resources, teaching materials or publications without our written permission.

6. Prohibited conduct

You must not:

  • copy, republish, sell, license or commercially exploit any part of this site, except as our Copyright and Intellectual Property Policy expressly allows;
  • use content from this site to train, fine tune or ground an artificial intelligence or machine learning system, or collect content from the site using scrapers, crawlers or other automated tools, other than a search engine crawler operating in the ordinary way and consistent with our robots file;
  • interfere with the operation or security of the site, attempt to gain unauthorised access to any part of it, or introduce any virus, malicious code or harmful component;
  • impersonate any person, or misrepresent your professional qualifications or your association with us;
  • use the site for anything unlawful, defamatory, harassing, discriminatory or misleading, or in a way that breaches another person’s rights;
  • remove, obscure or alter any copyright notice, author credit, disclaimer or attribution on our material; or
  • use the site in a way that damages our reputation or that of any person featured in our content.

We may suspend or block access to the site by any person we reasonably believe has breached these terms. Where it is practicable to do so, we will tell you why, and you can ask us to reconsider by writing to the address in clause 18.

7. Educational content, and what it is not

Everything published on this site is general educational information. It is not personal medical advice, it is not a diagnosis, and it is not a treatment plan for any individual.

Our content is written for a professional and student readership. It does not replace your own clinical reasoning. If you are a registered health practitioner, you remain responsible for the assessment, diagnosis, treatment and management of your patients, and for practising within your scope of practice. Our Medical, Clinical and Educational Disclaimer sets out what that means in full and forms part of these terms.

If you are not a practitioner, please do not use this site to self diagnose or to decide on treatment. Speak with a qualified health professional about your own situation.

Clinical evidence changes. Articles reflect our understanding at the time they were written and may not be current when you read them.

If you or someone else is experiencing a medical emergency, call 000 in Australia, or your local emergency number, immediately. Do not rely on this site.

8. Paid products and checkout terms (applies only if you purchase)

8.1 When this clause applies

8.1.1 This clause applies only if you purchase, subscribe to, or otherwise pay for any product or service we make available through the Site (a “Paid Product”), including any digital course, webinar, workshop, subscription, membership, downloadable resource or other paid educational content or access.

8.1.2 If you do not purchase a Paid Product, this clause does not apply.

8.2 Ordering and contract formation

8.2.1 A checkout, order confirmation, payment request or invoice issued through the Site is an invitation for you to make an offer to purchase the Paid Product.

8.2.2 A contract is formed when we confirm your order (including by email or by making the Paid Product available to you) and we receive payment (or, if we agree otherwise, when we confirm your order on agreed credit terms).

8.2.3 We may refuse or cancel an order (including due to pricing errors, suspected fraud, or where supply is not available). If we cancel an order after taking payment, we will refund the amounts paid for that cancelled order.

8.3 Prices, GST, recurring charges and changes

8.3.1 Prices are stated in Australian Dollars and are inclusive of GST unless we state otherwise at checkout.

8.3.2 If a Paid Product involves recurring charges (for example, a monthly subscription), we will disclose the billing cycle and renewal terms at checkout.

8.3.3 We may change prices for Paid Products from time to time. Any price change will apply only prospectively and will not affect a Paid Product already paid for in full. For subscriptions, we will give reasonable notice of a price increase before it takes effect and you may cancel before the increase takes effect (subject to any minimum term disclosed at checkout).

8.4 Access, delivery, and technical requirements

8.4.1 We will provide access to the Paid Product in the manner described at checkout (for example, access through your account, a link, or a downloadable file).

8.4.2 You are responsible for ensuring you have compatible devices, software, internet access and settings needed to access and use the Paid Product.

8.4.3 We do not guarantee that the Paid Product will be accessible on all devices or with all software. We may update the technical requirements from time to time.

8.4.4 If a Paid Product is time-limited (for example, access for a stated period, or access to a live webinar), the access period will be as stated at checkout. Unless stated otherwise at checkout, access begins on the date we first make the Paid Product available to you.

8.5 Licence and permitted use (Paid Products)

8.5.1 When you purchase a Paid Product, we grant you a personal, non-transferable, non-exclusive, revocable licence to access and use the Paid Product for your own education, study and professional development, subject to these Terms and any additional licence terms disclosed at checkout.

8.5.2 Unless we expressly agree in writing, you must not:

(a) share logins or access links;

(b) distribute, copy, resell, sublicense or commercially exploit the Paid Product or any part of it;

(c) upload the Paid Product to any platform, repository or shared drive; or

(d) provide the Paid Product to any other person as part of a training package, clinic resource bundle, patient handout pack, course, or internal education program.

8.5.3 Nothing in this clause transfers ownership of intellectual property in the Paid Product to you.

8.6 Events, webinars and rescheduling

8.6.1 If a Paid Product includes a live event (including a webinar), dates and times are as stated at checkout (including time zone, if specified).

8.6.2 We may reschedule a live event if reasonably necessary (for example, due to presenter illness, technical issues, safety reasons or events outside our control). If we reschedule, we will give reasonable notice where practicable and provide you with access to the rescheduled event or an alternative access method (such as a recording) where offered.

8.6.3 If we cancel a live event and do not provide a reasonable alternative, we will refund the amounts paid for that event.

8.7 Change-of-mind policy

8.7.1 We may (but do not have to) offer a change-of-mind refund policy for some Paid Products. Any change-of-mind policy, including time limits and eligibility criteria, will be stated at checkout or in the product description and forms part of the contract.

8.7.2 If no change-of-mind policy is stated for a Paid Product, change-of-mind refunds are not available.

8.8 Australian Consumer Law

8.8.1 Our Paid Products come with guarantees that cannot be excluded under the Australian Consumer Law.

8.8.2 Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (or any other law that cannot be excluded).

8.8.3 If a Paid Product fails to meet a consumer guarantee, you may be entitled to a remedy under the Australian Consumer Law. Depending on the nature of the failure, remedies may include a refund, replacement, repair, re-supply of services, or compensation for loss or damage.

8.9 Chargebacks and payment disputes

8.9.1 If you dispute a payment, you should contact us first and give us a reasonable opportunity to investigate and resolve the issue.

8.9.2 You must not make a chargeback (or payment reversal) for a valid charge. If you make a chargeback without a valid basis, we may suspend your access to the relevant Paid Product while the dispute is investigated.

8.10 Additional terms at checkout

8.10.1 We may set additional terms for a particular Paid Product (including duration of access, inclusions, assessments, eligibility requirements, and minimum term) which will be disclosed at checkout or in the product description.

8.10.2 If any additional Paid Product terms conflict with these Terms, the additional terms apply to the extent of the inconsistency, but only for that Paid Product.

8.11 Relationship to disclaimers

8.11.1 The medical, clinical and educational disclaimers that apply to the Site also apply to Paid Products, including that Paid Products are general educational information and are not personal medical advice.

9. Comments and other material you contribute

If the site allows you to post a comment or to send us material, you are responsible for what you submit. You must not submit anything unlawful, misleading, defamatory, abusive or in breach of anyone else’s copyright or confidence. You must never post patient identifying information, or clinical details that could identify a patient, in any form.

You keep ownership of what you submit. By submitting it you give us permission to publish, store, reproduce and adapt it in connection with the site, on a non exclusive basis and without payment, and you confirm you have the right to give us that permission. We may moderate, edit or remove any submission, and we are not obliged to publish anything.

If you break these rules, we will respond in steps. For a first or minor breach we will usually remove the material and give you a warning. If it happens again, we may suspend your ability to post or send us material for a period of time. For serious or repeated breaches we may block you permanently. We may go straight to a later step where a breach is serious, for example where material identifies a patient, is unlawful, or puts someone at risk. Any action we take will be reasonable and no more than is needed to deal with the breach, and you can ask us to reconsider by writing to the address in clause 18.

If you believe something posted on this site by another person is unlawful, defamatory or harmful, tell us at support@pivotalmotioneducation.physio. We will acknowledge you within 5 business days, assess the material, and remove it or block access to it within 7 days where we agree it should not stay up.

10. Links and third party material

This site links to other websites, research articles, products and services that we do not control. Those links are provided for convenience and reference. We do not endorse, guarantee or take responsibility for third party content, products, services or privacy practices, and you access them at your own risk.

Some of our articles contain affiliate links to Amazon, and we earn a commission if you buy through one, at no additional cost to you. As an Amazon Associate, Pivotal Motion Education earns from qualifying purchases. Every post that carries affiliate links says so at the top of the post, and our Affiliate Disclosure page explains how it works. This site also displays advertising served by Google AdSense. Advertisements are chosen by Google, not by us, and an advertisement appearing on this site is not an endorsement of the product or service advertised.

11. Availability of the site

We aim to keep the site available and accurate, but we do not promise that it will be uninterrupted, that every page is free from error, or that any article is current on the day you read it. We may change, suspend, restrict or withdraw the site or any part of its content at any time, including removing or updating articles.

12. Privacy

Our collection, use, disclosure and storage of personal information is described in our Privacy Policy, which forms part of these terms.

13. Your rights under the Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or under any other law that cannot lawfully be excluded, restricted or modified. Where the law does allow us to limit our liability, our liability is limited to the extent the law permits.

Our content is general educational material. Deciding how to apply it to a particular patient, client or situation is a professional judgement, and it stays with the person making it.

14. Limitation of liability

14.1 Australian Consumer Law

14.1.1 Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded (Non-Excludable Rights).

14.1.2 To the extent permitted by law, and subject to clause 14.1.1, we exclude all terms, conditions and warranties that would otherwise be implied into these Terms.

14.2 No liability for indirect or consequential loss

14.2.1 To the extent permitted by law, and subject to clause 14.1.1, we are not liable for any indirect, special or consequential loss, or loss of profit, loss of revenue, loss of opportunity, loss of goodwill, or loss or corruption of data, arising out of or in connection with:

(a) your use of (or inability to use) the Site or any content; or

(b) any Paid Product.

14.3 Limit on our liability

14.3.1 Subject to clause 14.1.1, to the extent permitted by law, our total aggregate liability to you for loss or damage arising out of or in connection with these Terms, the Site, any content, or any Paid Product (whether in contract, tort (including negligence), equity, statute or otherwise) is limited as follows:

(a) if the liability relates to a Paid Product that you have paid for: our liability is capped at the total amount you paid to us for that Paid Product in the 12 months immediately before the event giving rise to the claim; and

(b) if the liability does not relate to a Paid Product that you have paid for: our liability is capped at AUD $1,000.00 in total.

14.3.2 If the Australian Consumer Law (or another non-excludable law) permits us to limit our liability for breach of a consumer guarantee, then, to the extent permitted by law, our liability is limited (at our option) to:

(a) in the case of services: supplying the services again, or paying the cost of having the services supplied again; and/or

(b) in the case of goods or digital products: replacing the goods, supplying equivalent goods, repairing the goods, paying the cost of replacing the goods or of acquiring equivalent goods, or paying the cost of having the goods repaired.

14.4 Third party services and links

14.4.1 The Site may contain links to, integrations with, or functionality supplied by third parties (including hosting, analytics, payment processors, webinar platforms or other service providers).

14.4.2 To the extent permitted by law, and subject to clause 14.1.1, we are not responsible for and do not accept liability for the availability, performance, security or content of third-party websites, platforms or services.

14.5 Your responsibility for use of educational information

14.5.1 The Site and any Paid Products provide general educational information and are not personal medical advice. You are responsible for how you use or rely on that information.

14.5.2 To the extent permitted by law, and subject to clause 14.1.1, we are not liable for loss or damage arising from your actions or omissions in reliance on the Site or any Paid Product, including where you apply information without obtaining appropriate professional assessment or advice.

14.6 No broad consumer indemnity

14.6.1 You are responsible for any content you submit or upload to the Site (User Content).

14.6.2 You agree to indemnify us only for loss, damage, liability, cost or expense (including reasonable legal costs) arising directly from:

(a) your breach of these Terms; or

(b) a claim by a third party that your User Content infringes their intellectual property rights or is unlawful,

except to the extent that the loss is caused or contributed to by our breach of these Terms, our negligence, or our breach of Non-Excludable Rights.

14.7 Time limit for claims

14.7.1 To the extent permitted by law, and subject to clause 14.1.1, any claim you have against us arising out of or in connection with the Site or these Terms must be commenced within 24 months after the event giving rise to the claim.

15. Governing law, and readers outside Australia

These terms are governed by the laws of Queensland, Australia. You and we submit to the non exclusive jurisdiction of the courts of Queensland and the courts entitled to hear appeals from them.

The site is operated from Australia and is written from an Australian practice context. We welcome international learners, and part of our audience is overseas. We make no representation that the content is appropriate or available for use in any other country. If you access the site from outside Australia you are responsible for complying with the law of your own jurisdiction, including any law governing professional practice, health information and advertising. Where the law of your own country gives you mandatory consumer rights that cannot be excluded, this clause does not take them away.

16. General

If any part of these terms is found to be unenforceable, that part is severed and the rest continues to apply. A delay or failure by us to enforce any part of these terms is not a waiver of it. These terms, together with our Privacy Policy, our Copyright and Intellectual Property Policy and any disclaimer published on the site, are the whole of the agreement between you and us about your use of the site.

17. Order of precedence

17.1 These Terms incorporate by reference our other policies and documents that are stated to “form part of”, or be incorporated into, these Terms (Incorporated Documents).

17.2 If there is any inconsistency between these Terms and an Incorporated Document, then, to the extent of the inconsistency:

(a) these Terms prevail; and

(b) the Incorporated Document prevails only to the extent that it expressly states that it overrides these Terms for a specific topic and only for that topic.

17.3 If there is any inconsistency between two Incorporated Documents, the document that is more specific to the relevant topic prevails to the extent of the inconsistency.

17.4 For clarity, any additional terms stated to apply to a particular paid product or service at the time of checkout (Product Terms) prevail over these Terms and any Incorporated Document to the extent of any inconsistency, but only in relation to that paid product or service.
